Welcome to SERPEmpire.com, a website provided by Aperture United SL, Calle Simancas 80, 35010 Las Palmas de Gran Canaria, Spain ("SERP Empire", "we", "us", or "our"). This page explains the terms by which you may access and use our website and the software and services provided on or in connection with SERPEmpire.com (collectively, the "Services").
Please read this page carefully. These Terms and Conditions constitute a legally binding contract between SERP Empire and you.
Your legal agreement with SERP Empire consists of these Terms and Conditions and the Privacy Policy.
We supply the Services referred to on our website ("our site") to you. By joining our site and by ordering any of our Services, you agree to be bound by these Terms. We recommend that you print and save a copy of these Terms and Conditions for your records.
Our Services & Contract Information
1. Registration — Before you can use our Services you need to register (for free) on our site. On registration you will provide an email address and a password. Keep these safe at all times and do not disclose them to anybody. You are responsible for all activity that occurs under your account.
2. Minimum Age — You may only register if you have the legal capacity to enter into contracts in your country of residence and meet the minimum age required to do so.
3. Services — Our Services are listed on our site. SERP Empire provides automated search-engine traffic for the keywords and websites you configure within your campaigns. To order our Services, follow the instructions on our site. Your order constitutes an offer to subscribe to our Services, which we accept when we confirm your payment.
4. Nature of the Service and Third-Party Platforms — You acknowledge that search-engine and analytics platforms (including Google, Google Search Console, and similar services) are operated by third parties and are outside our control. Rankings, indexing, reported metrics, and the behaviour of those platforms may change at any time. We deliver the volume of searches that your campaigns are configured to request, subject to the delivery terms below. We do not guarantee any particular ranking, traffic, revenue, or business outcome, as these depend on factors beyond our control.
5. Contract — The contract between us is formed when we confirm your payment for a subscription.
6. Rules — When using SERP Empire you agree to obey all the rules of the website. You acknowledge that these rules may change over time and that you will comply with their most current form. In particular:
- You must not buy or sell SERP Empire accounts.
- You must not create multiple accounts.
- You must not use a VPN, proxy, or other tool for changing your IP address in order to abuse the Services.
- You must not purchase subscriptions using fraudulent credit cards or payment accounts.
- You must not buy or sell subscriptions from or to an external party.
- You must not post content that is hateful, threatening, or pornographic; that incites violence; or that contains nudity or graphic or gratuitous violence.
- You must not engage in unlawful multi-level marketing, such as a pyramid scheme, on SERP Empire.
- You must not upload viruses or other malicious code.
- You must not use SERP Empire to do anything unlawful, misleading, malicious, or discriminatory.
- You must not do anything that could disable, overburden, or impair the proper working of SERP Empire, such as a denial-of-service attack.
- You must not facilitate or encourage any violation of these Terms.
7. Monthly Subscription and Auto-Renewal — Your monthly subscription begins when we confirm your payment and continues for a period of one month. When you purchase a monthly subscription, auto-renewal is enabled by default in your SERP Empire account. At the end of each monthly period, your subscription will automatically renew and you will be billed for a further one-month term at the then-current price for your plan. We will give you reasonable advance notice of any change to the recurring price before it takes effect. You may turn off auto-renewal at any time by selecting "Cancel my subscription" in your account before the end of your current term; cancellation takes effect at the end of the term then in progress.
8. Searches, Delivery, and Campaign Configuration — Each subscription plan includes a defined number of monthly searches. The number of searches actually delivered depends on how you configure your campaigns, including features such as Keywords Auto-Discovery Mode, manual daily volumes, "Traffic during the week" settings, and "Exact URL" matching. Some of these features intentionally adjust or limit daily delivery (for example, Auto-Discovery Mode sets daily volumes based on your website's performance data). You are responsible for configuring your campaigns to consume the searches included in your plan. We provide documentation and support to help you do this, and our support team can review your configuration on request.
9. Delivery Shortfalls — If, in any monthly billing period, we deliver materially fewer searches than your plan provides for reasons attributable to us (for example, a technical fault on our side, as opposed to your campaign configuration or a third-party platform), you may contact our support team and we will, at your election, either (a) credit the undelivered searches to your account, or (b) issue a pro-rata refund for the undelivered portion of that period. To be eligible, you must raise the shortfall with us within sixty (60) days of the end of the affected billing period. This is your remedy for delivery shortfalls and is without prejudice to your mandatory rights under applicable consumer law.
10. Accumulated Searches (Credits) — Unused searches from a billing period are carried over and added to your account balance ("Credits"), subject to the following:
- Carryover cap. The total Credit balance carried in your account at any time is capped at two (2) times the monthly search allowance of your current plan. Searches that would cause your balance to exceed this cap are not accumulated.
- Expiry. Each Credit expires twelve (12) months after the date it was added to your account, if not used before then. We will make your current balance and, where reasonably possible, upcoming expiry information visible in your account.
- Use of Credits. Credits are consumed automatically by your active campaigns. To draw down a large accumulated balance you may need to increase your campaigns' daily volumes or run additional campaigns; our support team can help you configure this.
- Credits after cancellation. If you cancel your subscription, your remaining Credits stay available for use for thirty (30) days after the end of your final paid term. During this period you may keep campaigns running to consume them. After this 30-day window, any remaining Credits expire and your account may be closed. If you prefer, you may instead request a pro-rata refund of unused, paid-for Credits in accordance with the Refund Policy below, in which case refunded Credits are removed from your account.
- No cash value. Credits are a measure of prepaid Services and, except where a refund is due under these Terms or applicable law, have no independent cash value and are not transferable.
11. Right of Withdrawal and Refund Policy — If you are a consumer in the European Union, you have a statutory right to withdraw from your purchase within fourteen (14) days, in accordance with applicable EU and Spanish consumer law, except to the extent the Services have already been fully performed with your prior express consent. Nothing in these Terms limits any mandatory consumer right you have under the law of your country of residence.
In addition to your statutory rights, we offer the following:
- Satisfaction refund. If you are not satisfied with a new subscription, you may request a refund of that payment within fourteen (14) days of the charge, provided you have used no more than a minor portion of that period's searches. We will assess such requests in good faith.
- Refund for undelivered searches. You may request a pro-rata refund for paid-for searches that were not delivered to you, in accordance with the "Delivery Shortfalls" and "Accumulated Searches" sections above.
- Processing. Approved refunds are processed within fourteen (14) days, to the original payment method where possible. Where the original method cannot be used, we will agree an alternative method with you.
- Cryptocurrency. Payments made with cryptocurrency cannot be refunded to the original cryptocurrency wallet; where a refund is due, we will agree an alternative refund method with you.
To request a refund, contact us with your account email and purchase details. We welcome any feedback on why you are requesting a refund, as we use it to improve our Services.
12. Suspension and Termination — We may suspend or terminate your account if you materially breach these Terms (for example, by breaking the Rules above) or where required by law. Except in cases of fraud, abuse, or serious breach, we will give you reasonable notice before terminating an account that holds unused Credits, and we will allow you a reasonable opportunity to use or request a refund of those Credits in accordance with these Terms. We will not delete paid-for, unexpired Credits without either honouring them or refunding them as set out above.
13. Changes to These Terms — We may update these Terms from time to time. For changes that materially affect your rights or obligations, we will give you reasonable advance notice (for example, by email or via your account) before they take effect, and where the change is to your disadvantage you may cancel your subscription before it applies. Changes do not apply retroactively to Credits already accumulated or to refund rights already accrued under the version of the Terms in force when you purchased.
14. Hyperlinks — Our Services may contain hyperlinks to other websites that are not operated or controlled by SERP Empire. We have no control over and take no responsibility for the content, privacy policies, advertising, security, or activities of those other websites.
15. Third-Party Platform Risk — SERP Empire is not responsible for any closure, suspension, or penalty applied to your accounts on third-party platforms (including but not limited to Google, Google Ads/AdSense, Facebook, Instagram, X/Twitter, YouTube, Pinterest, or similar services). You are reminded that use of services such as ours may be contrary to the terms of those platforms. We take reasonable precautions to protect our customers but provide no protection against, and accept no liability for, actions taken by the operators of other platforms.
16. Liability — To the fullest extent permitted by law, and except in respect of liability that cannot lawfully be excluded (including liability for fraud, for death or personal injury caused by negligence, and any mandatory consumer-law liability), SERP Empire's total liability arising out of or in connection with the Services shall not exceed the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, or for loss of profits, rankings, revenue, or goodwill.
These Terms, and your relationship with Aperture United SL under them, are governed by Spanish law. You and Aperture United SL submit to the jurisdiction of the Spanish courts to resolve any dispute concerning these Terms. Where you are a consumer, this does not deprive you of the protection of any mandatory provisions, or of the right to bring proceedings in the courts, of your country of residence. Without prejudice to the above, you agree to Aperture United SL's right to seek urgent or precautionary measures in any competent jurisdiction.
Anyone found to be breaking these Terms may be removed from SERP Empire. If you do not accept these Terms, you will not be able to use this site or our Services.
